Presentation

In 2016, the Sapin II law established a whistleblower status, but its definition and applications remained unclear.

The law n°2022-401 of March 21, 2022, known as the Waserman law, has modified the figure of the whistleblower on various points and attempts to increase his protection regime. The notion of whistleblower remains complex and difficult to grasp by the law. However, it is a social fact that cannot be denied, the disclosure of the Pentagon Papers, the Mediator affair or the Panama Papers scandal are all examples that show the importance of whistleblowers in our society.

Our approach here will be sectorial: we will present the protection regimes and the points of debate relating to whistleblowers in different branches of law.
