Presentation : The question of the triggering of the application of the rules of private international law is a primordial but very delicate issue. Moreover, it is not possible to provide a general answer, common to all branches of law. This colloquium therefore proposes to study the question of the foreign element triggering the application of the rules of conflict of laws or of jurisdictions. A study by subject, led by academics, will first be made in the morning and early afternoon. While the rest of the day will be devoted to a round-table discussion/debate with practitioners (magistrates and lawyers), academics and the audience. The central questions of this debate will be in particular: the influence of the nature of the foreign element on the triggering of the rules of private international law, the difficulties related to the late discovery of the foreign element, the instrumentalization by lawyers of the foreign element, the reaction of the judge to the foreign element, the difference between the triggering of European and domestic conflict rules...

The study day is offered in person only. It is validated as part of the continuing education of lawyers and magistrates.
