In their political reflections, libertarian and anarchist thinkers have been keen to evoke the law and understand its history. But, faced with a conception of law based on a more or less conscious acceptance of the notion of the State, sanctioning law via a legitimate violence of which it has a monopoly, they looked to the margins, both temporal and spatial, for forms of non-state rights, that " ius " which was not lex. To do so, they turned to history, particularly the history of law and institutions, and to other human sciences, anthropology and ethnology, applied to legal concepts. It is the place of this gaze, towards the past or the contemporary margins, and its method within libertarian thought that we wish to question.
