Clone of DU National Certificate of Competence as a Legal Representative for the Protection of Adults and/or Head of Service option

This diploma aims to offer a specialisation in the field of the social and solidarity economy, which today raises particular problems in business law. However, these are only addressed at the margin in the classic LM curriculum.

The lessons will allow to approach all the fundamentals of the SSE law and in particular the functioning of the various structures of this sector: associations, endowment funds, cooperative companies, mutual companies, health, social and medico-social establishments...

Labour law, taxation, accounting, financing and comparative law will also find a place in order to offer a global approach of the sector.

Who is this course aimed at?
Professionals in the social and solidarity economy (SSE) sector wishing to acquire or consolidate a sound understanding of the law: administrative managers, organisation directors, and project officers within a federation or union.
Lawyers or law firm associates wishing to develop expertise in social and solidarity economy (SSE) law, a rapidly growing sector that is inadequately covered by existing specialist training programmes.
Law, economics, management or accountancy students wishing to specialise in a sector where there is high demand for legal expertise.

The course is delivered entirely online. Only one visit is required during the year: the final oral examination
, held at the Faculty of Law and Political Science's Aix campus.

The e-learning modules (80 hours) allow you to progress at your own pace; the practical sessions
(40 hours) provide direct links with professionals in the sector throughout the year.

The course is structured into three sections:

1. Introduction to the Social and Solidarity Economy (SSE)
History of SSE ideas and policies; economic and sociological aspects; statistical
and sectoral overview; the SSE in relation to CSR; SSE institutions

2. The main categories of the SSE
Law governing associations (fundamentals, health and social sector, governance, litigation); co-operative law (common principles, SCICs, agricultural co-operatives, SCOPs, co-operative audits); foundations and endowment funds; mutual societies; SSE commercial companies, ESUS accreditation and funding.

3. The legal environment for social and solidarity economy organisations Labour law as it applies to social and solidarity economy organisations; taxation; accounting, management and auditing of accounts; public law and competition; organisations in difficulty and restructuring; challenges related to digitalisation.

To master the law, taxation, accounting and the fundamental principles of SSE law and in particular the functioning of the different structures of this sector and their particular modes of functioning.

Ability to consider the problems of the social and solidarity economy in a transversal way. Ability to dialogue with the various functions of the company involved in the social and solidarity economy. Acquisition of a culture of the social and solidarity economy.
