The rise of illiberal or authoritarian political forces around the world raises questions about the democratic legitimacy of constitutional courts as much as their ability to effectively protect democracy. In this context, normative or liberal constitutionalism, which promotes the supremacy of jurisdictional interpretations of the Constitution, is being challenged by other approaches, such as popular constitutionalism. The latter is currently experiencing a revival of interest because it advocates increased participation of the people in the production, and especially the interpretation, of constitutional statements. This study day will examine the extent to which popular constitutionalism allows us to consider the opportunity and the modalities of a democratization of constitutional justice.
