The State’s public action no longer operates exclusively within the traditional framework of public law or solely within the boundaries of the domestic legal order. It also draws upon instruments of private law and operates within a regulatory environment shaped by European and international law. In this context, the State’s regulatory authority appears to have undergone a profound transformation. The issue is therefore no longer merely that of regulation itself, but also thatof the scope of the State’s discretion.
